1. Acceptance of terms

Every visit to or use of COLDBORE (the website, listings, messaging, profiles, and related services) means you accept these Terms without limitation. If you do not agree, do not use the site. We may update these Terms by posting a revised version here. Continued use after changes are posted is acceptance of the updated Terms. Please review this page periodically.

2. Platform nature

COLDBORE is an online classifieds platform for firearms-related goods and gear directed to users in Canada. It lets users create listings, browse inventory, and message other users. COLDBORE is not a licensed firearms dealer, broker, escrow service, payment processor, or shipping carrier. We do not take possession of listed items and do not complete transfers of ownership on your behalf.

COLDBORE is directed to individuals and entities located in Canada who can form legally binding contracts under applicable law. Do not use the site from a place where access or use is illegal or prohibited. You alone are responsible for determining whether your use is lawful where you are.

3. Age, firearms eligibility & location

You must be at least 18 years old to create an account or use COLDBORE. By registering or using the service, you represent that you are 18 or older.

You represent that you are not prohibited under Canadian law from possessing firearms, firearms parts, ammunition, ammunition components, or other regulated items you interact with on the platform, and that you have not been convicted of firearms offences that would make your participation unlawful.

You will only engage with listings and communications you are lawfully allowed to participate in, including having any licences, certificates, or authorizations required for the items involved.

4. User responsibility & compliance

You are solely responsible for ensuring that your use of COLDBORE — including what you post, buy, sell, discuss, or arrange — complies with all applicable federal, provincial, territorial, and local laws and regulations. This includes firearms licensing, storage, transportation, advertising restrictions, and transfer requirements. Illegal activity is prohibited and may result in account action and referral to authorities where required.

5. Transfers must follow legal channels

Any transfer of a firearm or other regulated item must be completed through lawful channels where required (for example, through a business with the appropriate licences, or other processes mandated by law). Users must not use COLDBORE to facilitate unlawful transfers. For regulatory questions about transfers or ownership, contact the Chief Firearms Officer (CFO) of your province or territory.

6. Not a party to transactions

COLDBORE is not a party to any transaction between users. All sales, trades, offers, payments, shipping, meetups, inspections, and transfer arrangements are solely between the users involved, at their own risk. We do not broker, guarantee, insure, escrow, or underwrite any deal. An ad or listing on COLDBORE is not an endorsement by COLDBORE of the seller, buyer, item, or price.

7. Listing & content rules

When you post a listing, message, profile content, or other material, you must follow these rules. Violations may lead to removal of content and account restrictions.

• Items offered for sale or trade must be in your possession. Do not sell on behalf of others (including estate sales) unless you are lawfully authorized and clearly disclose that fact — you remain fully responsible for the listing and outcome.
• Descriptions must be accurate and factual at the time of listing. Photos must be your original photos of the actual item(s) you are offering.
• Do not post illegal, stolen, counterfeit, or otherwise questionable items. Do not post content that infringes trademarks, copyrights, or other rights (including knock-offs with protected markings).
• Do not post tobacco, cannabis, alcohol, controlled substances, or fully assembled non-commercially produced ammunition where prohibited. Do not post any item you are not legally allowed to advertise or transfer.
• No harassment, threats, hate, spam, scams, impersonation, or sharing another person's private information without consent.
• Do not use messaging or listings to demand unsafe payment practices meant to deceive (for example, requiring funds before a legitimate offer process in a misleading way), or to run auction-style bidding that we prohibit on the platform.

We may remove or refuse any listing or content at our sole discretion, with or without notice, including content we believe violates law, these Terms, or the integrity of the marketplace.

8. Commercial & dealer sellers

Individual users may post personal items they own. Commercial dealers, manufacturers, and for-profit sellers may also use COLDBORE if they are lawfully authorized to do so in Canada and follow all applicable firearms and business laws.

Commercial sellers must not misrepresent themselves as private individuals. They remain fully responsible for licences, advertising restrictions, record-keeping, and lawful transfers. Paid site advertising (see below) is separate from ordinary listing posts and does not replace any legal obligations of a dealer.

9. Paid advertising & sponsored slots

COLDBORE may display advertising slots (including “Advertise here” placeholders) and may sell sponsored placements. Advertisements are not endorsements of any business, product, or service. Sponsored content is separate from peer-to-peer listings.

Advertisers are responsible for the accuracy and legality of their ads. COLDBORE may refuse, pause, or remove advertising at our discretion. For size, duration, and cost, contact us via the Contact page.

10. Licence to host your content

You retain ownership of content you submit (listings, photos, text, messages, profile details). By posting or uploading content, you grant COLDBORE a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, distribute, and otherwise use that content as needed to operate, improve, promote, and protect the service (including showing listings publicly and enabling messaging).

You represent that you have the rights needed to grant this licence and that your content does not violate law or third-party rights. We may preserve or disclose content when required by law or to enforce these Terms and protect users.

11. Service provided “as is”

Your use of COLDBORE is at your own risk. The website and services are provided on an “as is” and “as available” basis, without representations, warranties, or conditions of any kind, express or implied — including merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, or uninterrupted / error-free operation — to the fullest extent permitted by law.

We do not warrant that the site will always be available, secure, free of viruses or harmful code, or that information (including prices, availability, or descriptions) is accurate or current. We may modify, suspend, or discontinue any part of the service at any time without notice or liability.

12. Limitation of liability

Listings, messages, images, descriptions, prices, claims, and other user content are created by users — not by COLDBORE. We do not verify the accuracy, legality, condition, ownership, or authenticity of any listing or statement made on the platform.

To the fullest extent permitted by law, COLDBORE, its operator, owners, developers, volunteers, contractors, and affiliates are not liable for any loss, damage, dispute, injury, claim, or cost arising from:

• Items sold, purchased, offered, or discussed on the site
• User messages, agreements, meetups, payments, or offline arrangements
• Fraud, misrepresentation, or disputes between users
• Technical outages, data loss, bugs, or unauthorized account access
• Any reliance on information posted by users, advertisers, or third parties
• Third-party websites, ads, or services linked or referenced from COLDBORE

Some jurisdictions do not allow certain warranty exclusions or liability limits. Where those laws apply to you, our liability is limited to the maximum extent permitted.

13. Indemnity

You agree to defend, indemnify, and hold harmless COLDBORE, its operator, owners, developers, contractors, and related parties from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the site; (b) your listings, messages, or other content; (c) your transactions or dealings with other users; (d) your violation of these Terms; or (e) your violation of any law or third-party right.

14. Account status, removal & enforcement

Access to COLDBORE and any verification or special status is a privilege, not a right. We may investigate reports and take action at our sole discretion, with or without prior notice.

Verified status may be granted by COLDBORE admin to accounts that meet our trust standards. It is shown as a badge next to a display name. Verified status does not mean COLDBORE has inspected firearms, verified licensing, or endorsed any listing or transfer. We may remove verified status at any time.

We may remove listings or messages, restrict features, lock accounts, or remove verified status for conduct including, but not limited to:

• Fraud, scams, or deliberate misrepresentation
• Harassment, threats, or abusive messaging
• Posting illegal items or prohibited content
• Attempting unlawful transfers or circumventing firearms laws
• Spam, impersonation, or repeated policy violations
• Sharing another person's private information without consent

Serious or repeated violations may result in permanent removal. Decisions on enforcement are final unless we choose to reconsider. We may preserve and disclose information when required by law or to protect users and the integrity of the service.

15. Reporting abuse or illegal activity

If you believe a listing, message, or user violates these Terms, involves fraud, harassment, or illegal activity, use the in-app Report form (signed in) — it messages COLDBORE admin in Socials. You can also email ballin.webdevelopment@outlook.com with the subject line “COLDBORE report”. Include links or IDs for the listing/conversation, screenshots if useful, and a short description. Allow up to 72 hours for a response. Emergency or imminent harm situations should be reported to local authorities first.

Reporting does not guarantee a particular outcome. We may act, request more information, or take no action based on the facts available.

16. No legal advice

Nothing on COLDBORE constitutes legal advice. Content on this site — including this Legal page and the Privacy Policy — is for general informational purposes only. Consult qualified professionals or your provincial/territorial CFO for advice specific to your situation.

17. Governing law

These Terms and any dispute arising from your use of COLDBORE are governed by the laws of the Province of Saskatchewan and the applicable federal laws of Canada, without regard to conflict-of-law rules. You agree that courts in Saskatchewan have exclusive jurisdiction, except where mandatory consumer-protection laws in your province or territory require otherwise.

If any part of these Terms is found unenforceable, the remaining parts stay in effect. Our failure to enforce a provision is not a waiver. These Terms are the entire agreement between you and COLDBORE regarding the service.

18. Changes

We may update these Terms from time to time. Continued use of COLDBORE after changes are posted constitutes acceptance of the updated Terms. The “Last updated” date at the top of this page will change when we revise them.
